It Makes Sense

Yesterday, i said the Supreme Court was going to come up with a couple of 8 to 0 decisions.  I had been giving this some thought for a while, but i didn't think about writing it down until yesterday morning.

And it makes sense on several different levels:

  1. It would mean that the Chief Justice has regained control of a questionable Court.  John Roberts is too good of a Chief Justice to go down in history viewed as a Court who supported "minority views" (e.g., abortion, campaign funding, etc.).  An 8 to 0 vote shows who is in charge of the Court.
  2. It is consistent with the separation of powers--executive, legislative, and judicial.  The question regarding the Fourteenth Amendment makes you wonder whether Jefferson Davis or Robert E. Lee could become President.  What would have happened if either of those two men decided to run for President?  And everybody knows the answer to that!  They wouldn't have been allowed.  Period.  And it would not have taken a court case to resolve the issue.  It's in the Constitution that they did not qualify for being President.  And if the issue had been pushed in the 1860s, the question would surely have been sent to the Supreme Court to decide the issue.  Or do you think the Supreme Court at the time would have "balked" on the issue if you brought it in front of them.  Would the 1860s Supreme Court say no, Davis and Lee, have not been proven to be seditionists in a lower court, so we cannot rule on it on our own.  That would never happen.
  3. The separation of powers issue is worth raising a second time.  The Supreme Court must stand alone by itself without any undo influence by the Executive and Legislative branches.  And the Court that John Roberts rules over has the reputation of not being independent of the other two branches.  An 8 to 0 decision changes that perspective.
  4. What about setting a precedent?  No problem.  It is the Supreme Court who is ruling--not supposedly some political party.  Who should decide if something is seditious or is not seditious--if not the Supreme Court.  The Supreme Court is the last chance to interpret the meaning of the Constitution and its Amendments (if they are not one and the same).  How, then, could this John Roberts Court "balk" at making a decision regarding the issues in front of them.
  5. An 8 to 0 decision with one abstaining also sends a message about Justice Clarence Thomas.  It is a time to resign from the John Roberts' Court.  This will send a message throughout the rest of the men and women on the court.  It shows that Roberts is in charge (in lieu of Thomas) and it will do much to reduce all the "special perk" issues that is going on.

Now the above are all the legitimate legal reasons the Supreme Court should go 8 to 0.  Here are all the benefits.

  1. The "el Trumpo" is done, his ass is cooked, and the only thing left to do is to start the "trial for his sedition".  And there is nothing even the loudest of "el Trumpo's" cult could do about it.  It was a Supreme Court decision.  "El Trumpo's" reputation will quickly deteriorate--faster, much, much faster than his rise.  If you really dig down and look at the strength of "el trumpo's followers" you will quickly find out that their bark is much worse than their bite.
  2. It would mean we get a Haley-Biden choice.  From my perspective, we could not lose.  I might believe that Biden would be better than Haley, but by no means would i be disappointed with Haley.  She seems like a really good person.  Maybe she isn't as bold as i wish, but i also think she is learning.  And considering that i have given the Biden Adminstration all the help i could these past few years without much results, it wouldn't be too hard for me to jump ship.  That is something i cannot do when the "el trumpo" is an option.
  3. A Haley-Biden race would mean that the United States is safe.  That it really is back to being what it has tried to stand for these past 250- years.

So, there you have it.  The reasons why the Supreme Court voted 8 to 0 and the goodness of their decision.  Good for you, John Roberts.  As a fellow Hoosier, i am proud of the effort that you put in to regain "control of your Court".

ps.  BTW, i did go this past week (8 days) without any alcohol.  It was kind of a test to see whether it caused me any problems or not.  It really didn't, so yesterday i went out and bought some Mike's lemonades.  And if it is sunny, after my walk this morning, i think i will sit out on the front porch with the dogs and have a few Mike's.  I am not afraid of my drinking, i just know that i have to watch and control it.
