While a number of corporate scandals are being publicly proclaimed by newspaper organizations every year, it is important to note that most of these are financial in nature. One of the most significant corporate scandals in history was the now infamous case of Enron as most of the accounting issues were  created not only by its managers but also its employees. The potential reason for the inclusion of the employees within the scandal is that higher level managers may have compelled the employees to conform to their demands or face termination. Some employees having existing debt or family obligations may have had no choice but to comply with the manager’s demands especially if they are given bonuses to keep quiet. Fortunately this is not the case for currently employed personnel since the government have already changed some of more detrimental labor laws.

The problem is that a number of other employment issues have come up and the most significant of them is workplace discrimination. Employment lawyers disclosed that discrimination issues is a major problem within companies since it could be used to prevent promotions for qualified but low priority employees. One of the more prominent and contentious qualification issues is that of gender since management believes that women employees will require a higher number of leaves due to family commitments. Unfortunately for male employees this is not the case since they can be discriminated against due to sexual preference, religion and even physical deformities. The MA employment lawyers concur with this assumption since employees in other industries can be discriminated against and this includes bartenders, receptionists and camp counsellors.

The most common issue reported by employees is with regards to their wages especially if two employees working the same tasks and responsibilities are being paid at different compensation brackets. Another potential issue within this scope is if the employee is being paid below the allowable and legal minimum wage set by the state or the government. A potential reason that could be given by the company is that employees paid at a lower bracket are considered as temporary workers. Permanent employees can also have employment issues especially if the company does not provide pension benefits for their eventual retirement. This is because companies normally struggle when the government changes employer regulations especially with regards to taxes and pension benefits. This does not include government solutions to trending workplace issues such as job discriminations due to the employee’s race, color and age.

The reason for this is that employment issues is becoming larger in both scope and range, which means that discrimination issues are only a minor problem tackled by employment lawyers. This is because the number of bullying and harassment issues within the workplace is increasing based on employee reports. The more common harassment cases filed is by women against their male bosses as concurred by a number of employment lawyers throughout the years. However, an increasing number of harassment cases are being filed by male employees against either a female or male superior. Unfortunately, the percentage of actual harassment cases are higher than those officially filed since the employees can be financially threatened by their superiors through job terminations or a demotion. This is especially prominent within large corporations, which is why the offending superior is normally moved to another branch or location. The purpose of moving the superior in a lateral position is to prevent retaliation especially for the employees that report the harassment. Another potential reason for the employee to keep quiet is to minimize public humiliation not only for the employee but also to the company especially when they have to testify against the offender or superior. The problem with this type of thinking is that the offender will eventually go back to their old ways and harass other employees in their new location. One way to prevent this reoccurrence is to report the offender and this is the recommended action given by an employment attorney.

It was the same with Wells Fargo $WFC. Both management and employees were involved with their scandal and the employees that spoke up were fired. So this does still happen.
