If you're a landowner, it's important to know your right when it comes to eminent domain. There is a growing concern among landowners across the nation and in your very backyard. Eminent domain, based on the 5th Amendment, allows the government the ability to seize private property without the owner's consent - with 2 caveats. First, as long as they provide just compensation, and that the land must be claimed for public use.
The question is: what is "just compensation?" This is up for debate and landowners are often now getting their just desserts.
Here’s what to expect if you are targeted in an eminent domain case:
- Property owners will receive a notice of intent by mail
- Appraisers will access the size and value of your land
- Purchase offers are made based on that appraised value
