Don't Sign Until You've Checked These Things in Your Rental Agreement

A rental agreement in Kerala is a legal document, not a formality — yet most first-time tenants sign without reading past the rent amount and the move-in date, which is exactly how avoidable disputes happen months later.

Before you sign, verify these points carefully:

  • The owner's name on the agreement matches their ID proof and the property tax receipt exactly

  • There's no ambiguity about who pays maintenance, water charges, and society fees on a monthly basis

  • The notice period and lock-in clauses are clearly stated in writing, not left vague or verbal

  • The deposit amount and refund conditions are written down explicitly, not just promised in conversation

  • Any restrictions on subletting, guests, or modifications are spelled out rather than assumed

Kerala doesn't mandate registration for short-term leases, but a notarized agreement still holds up far better in a dispute than a purely verbal understanding or an unsigned draft. The small cost and time involved in notarization is negligible compared to the protection it offers both tenant and owner.

Ask the owner directly whether the property has any pending litigation, disputed ownership, or unresolved loan against it — a simple, direct question that saves enormous trouble later if the answer turns out to be complicated. If they hesitate or give a vague answer, treat that hesitation as useful information in itself.

Take dated photos of the flat's condition, including any existing damage, before moving in. It's a five-minute step that prevents deposit disputes down the line, since disagreements about pre-existing wear and tear are one of the most common sources of friction at move-out time.

Finally, keep a copy of every payment receipt, whether it's the deposit, advance rent, or monthly payments. Digital transfers create their own record, but a written or messaged confirmation from the owner adds an extra layer of clarity that protects both sides equally.
